These Terms and Conditions (“Terms”) govern your access to and use of all services, programs, products, and digital platforms offered by Castor Home Health Solutions, including our website, mobile applications, healthcare services, medical supplies, non-emergency medical transportation services, and healthcare institute training programs.

By accessing or using the website and services provided by Castor Home Health Solutions, you agree to be bound by these Terms. If you do not agree with these Terms, you are prohibited from using this website and our services.

These Terms constitute a legally binding agreement between you and Castor Home Health Solutions. We reserve the right to modify these Terms at any time, and your continued use of our services following any modifications constitutes acceptance of the updated Terms.

2. Eligibility

To use our services, you must be at least 18 years of age or the age of majority in the State of Illinois, possess the legal capacity to enter into a binding agreement, and provide accurate, complete, and current information during registration, clinical intake, and course enrollment.

If you are enrolling in services or purchasing medical supplies/equipment on behalf of a minor child, a pediatric patient, or another individual for whom you act as a legal guardian or designated representative under Illinois Department of Public Health (IDPH), Division of Specialized Care for Children (DSCC), or Division of Rehabilitation Services (DORS) guidelines, you represent that you have the explicit legal authority to do so and that the individual (or their legal estate) agrees to these Terms.

3. Description of Services & Regulatory Alignment

Castor Home Health Solutions provides a multi-faceted healthcare, logistics, and educational platform structured under the following operating divisions:

  • Castor Home Nursing Inc. (Healthcare Services): Offers The Joint Commission accredited, IDPH-licensed Home Care, Home Health, and Private Duty Nursing (PDN) services. This includes 24/7 skilled nursing shift care, hourly care, and visit-based support executed by carefully matched Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs).
  • Castor Health Institute: An Illinois Board of Higher Education (IBHE) approved and IDPH-administered training facility providing Certified Nursing Assistant (CNA) programs, Phlebotomy programs, CPR certifications, and onsite healthcare training/skills refreshment modules.
  • Castor Medical Supplies: A fully approved, retail-authorized, Medicare and Medicaid credentialed provider of specialized durable medical equipment (DME) and pediatric/adult clinical supplies (wheelchairs, hospital beds, oxygen, respiratory equipment, enteral feeding/nutritional items, and incontinence supplies) sourced directly from authorized manufacturer distribution networks.
  • Non-Emergency Medical Transportation (NEMT): State-compliant, medically adapted, and specialized safety transportation services operating under strict Illinois regulatory policies and vehicle compliance frameworks.

As a Joint Commission-accredited organization, Castor Home Health Solutions is dedicated to providing the highest quality of care and ensuring absolute patient safety. If your concern cannot be resolved through our internal management team, you have the absolute right to report your concern directly to The Joint Commission’s Office of Quality and Patient Safety (OQPS). Castor maintains a strict zero-retaliation policy; no disciplinary, discriminatory, or retaliatory action will ever be taken against a patient, family member, or employee who reports a safety or quality concern.

4. Website Usage Rules

If you create an account, access a student portal, or utilize a dedicated home-charting computer provided by Castor for paperless real-time clinical charting, you are solely responsible for maintaining the confidentiality of your credentials. You agree not to upload malicious code, engage in data scraping, disrupt website servers, or use online contact forms to send unsolicited spam.

5. Appointment Scheduling, Clinical Intake, and Bookings

Scheduled care hours and clinical shifts are subject to clinical assessment, staff matching availability, and official confirmation by our intake department. You agree to complete all mandatory registration forms, physician order verifications, plan of care (POC) approvals, and insurance authorization forms prior to the initiation of service.

⚠️ IMPORTANT NOTICE: A submission via an online form, digital scheduling link, or inquiry portal does not constitute a guaranteed clinical placement or contract for care until explicitly confirmed by an authorized Castor Home Health Solutions intake coordinator via phone or secure, encrypted electronic transmission.

6. Medical Transportation Terms

Our Non-Emergency Medical Transportation (NEMT) services require advanced scheduling and are bounded by state regulatory policies. Passengers must be medically stable for transit. Our drivers are thoroughly background-checked, drug-screened, and trained in safe patient transfer and mobility protocols, but they do not provide active emergency clinical intervention in transit.

7. Medical Supply Orders, E-Commerce, & Retail Policy

Certain professional-grade equipment, respiratory care machinery (Oxygen, CPAP/BiPAP), or specialized diagnostic items require a valid, verifiable prescription or physician order under FDA and State of Illinois rules. Castor reserves the right to withhold fulfillment or cancel transactions until our intake team verifies the necessary medical documentation.

If you request that we bill Medicare, Illinois Medicaid, or private commercial insurance (including DSCC or DORS waiver networks) for durable medical equipment or supplies, you understand that you or your designated guarantor remain personally liable for any deductibles, co-insurance, or non-covered items determined by your structural payer policy.

8. Educational Program Disclaimer

Enrollment in courses through the Castor Health Institute is subject to separate institutional enrollment agreements, student disclosures, and tuition rules. Program curricula, clinical rotation schedules, instructors, and formats are subject to change at the institution's discretion to maintain compliance with IBHE and IDPH blueprints. Completion of our educational modules, CNA training, phlebotomy tracks, or prep courses ensures eligibility to sit for testing but does not guarantee state licensure, registry placement, or external employment.

10. User Conduct & Prohibited Behavior

You agree to communicate with our staff, field clinicians, nursing supervisors, educators, and transport drivers with respect, safety, and courtesy. We reserve the absolute right to terminate clinical services, cancel training enrollments, refuse retail service, or block website access for any user who engages in abusive, threatening, discriminatory, or fraudulent behavior.

11. Disclaimer of Warranties & Limitation of Liability

THIS WEBSITE AND ALL SERVICES, CLINICAL PROGRAMS, TRANSPORT ASSETS, AND PRODUCTS PROVIDED ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CASTOR HOME HEALTH SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF ILLINOIS.

SECTION 2: PRIVACY POLICY & HIPAA

Castor Home Health Solutions is committed to protecting the privacy and security of your personal, financial, and medical information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information.

1. HIPAA Compliance Statement & Protected Health Information (PHI)

To the extent that we act as a “Covered Entity” or “Business Associate” under HIPAA, we protect your Protected Health Information (PHI) in strict accordance with the HIPAA Privacy, Security, and Breach Notification Rules. Your PHI will only be used or disclosed for purposes of Treatment, Payment, and Healthcare Operations (TPO) unless you provide explicit written authorization, or as otherwise permitted or required by law.

2. Information We Collect

We collect personal details (name, email, phone, SSN where legally required for background/student verification), insurance and waiver details (Medicare/Medicaid/DSCC/DORS data), medical histories, clinical charting files, and financial transaction records through secure payment processors.

Patient and Consumer Rights

Under federal HIPAA regulations and Illinois clinical standards, you possess the right to inspect and obtain copies of your medical and billing records, request amendments, restrict certain uses, and request disclosure records.

Right to Freedom from Retaliation for Quality Reporting:

In strict alignment with Joint Commission Leadership (LD) standards and Patient Rights (RI) guidelines, patients and their legal guardians possess the explicit right to voice grievances regarding care or communicate directly with our accrediting body (The Joint Commission) regarding any perceived gaps in clinical safety without fear of coercion, discrimination, or a reduction in your authorized care hours.

3. Data Retention & Biometric Security

We retain medical records for a minimum of ten (10) years following the last date of service, or in the case of a minor, until the minor reaches the age of majority plus the statutory window. We explicitly declare that we do not collect, store, or utilize biometric identifiers (BIPA) through our public website.


SECTION 3: REFUND & CANCELLATION POLICY

A. Healthcare Services & Home Nursing Visits

Patients or legal guarantors must cancel or reschedule clinical home health visits, assessment visits, or shift nursing hours at least 24 hours prior to the scheduled appointment window. Insurance companies (Medicare, Medicaid, DSCC, DORS) cannot legally be billed for missed appointments or no-shows; therefore, any late cancellation or no-show fees will be billed directly to the primary guarantor.

B. Medical Transportation (NEMT)

Transportation bookings must be cancelled at least twelve (12) hours prior to pick-up for a 100% refund. Cancellations made less than 12 hours prior will be subject to a cancellation fee equivalent to 50% of the scheduled transit cost.

C. Medical Supplies & Equipment Returns

Unopened, unused medical supplies and equipment in their original, sealed packaging may be returned within 30 days of purchase for a full refund (minus shipping/restocking fees). Defective or damaged items must be reported within 48 hours. Open items, wound care, incontinence supplies, and custom orthotics/braces are strictly non-returnable due to infection control protocols.

D. Castor Health Institute Academic Programs

Tuition refunds for students enrolled in CNA, phlebotomy, or CPR courses follow strict deadlines:

  • Cancellation ≥ 14 days prior to course start: 100% tuition refund (minus administrative fees).
  • Cancellation 7 to 13 days prior to course start: 50% tuition refund.
  • Cancellation < 7 days prior or after course launch: No refund available.

SECTION 4: MEDICARE/MEDICAID DMEPOS SUPPLIER STANDARDS

In accordance with federal regulations outlined in 42 CFR § 424.57(c), Castor Medical Supplies explicitly discloses and adheres to the Centers for Medicare & Medicaid Services (CMS) Medicare DMEPOS Supplier Standards. A complete, unedited copy of the 30 Supplier Standards is physically posted at our retail facility and is available electronically to every beneficiary upon request.

Product Warranties & Repairs

Castor honors all manufacturer warranties. We will repair or replace, free of charge to the beneficiary, any covered equipment under active warranty. Castor will unconditionally accept the return of any item that is found to be substandard or determined by a clinician to be clinically unsuitable at the time it was fitted, rented, or sold.

SECTION 5: MEDICARE/MEDICAID DMEPOS SUPPLIER STANDARDS & BOC ACCREDITATION DISCLOSURES

Castor Medical Supplies maintains a fully accredited physical commercial facility located at 30 E Stephenson St, Freeport, IL 61032. In strict accordance with the Board of Certification/Accreditation (BOC) and federal CMS quality guidelines, this location features permanently visible exterior corporate signage, fits adaptive gear in a private room, and maintains designated equipment repair spaces.

SECTION 6: STATE OF ILLINOIS LICENSE & CONSUMER DISCLOSURES

Castor Medical Supplies acts in strict compliance with the Home Medical Equipment and Services Provider Licensing Act of 1998. Our physical operations and digital fulfillment workflows are regulated by the Illinois Department of Financial and Professional Regulation (IDFPR), Division of Professional Regulation.

Our Home Medical Equipment Provider license is maintained at our physical headquarters (30 E Stephenson St, Freeport, IL 61032). Castor is fully authorized under Illinois law to provision Category I and Category II equipment.

Prohibited Financing and Brokering Services

In compliance with Illinois transparency statutes, Castor Medical Supplies does not act as a broker or provide practice-branded/customized application portals or QR codes for third-party medical loans. If financing partner options are shown, they are presented via unbranded links that clearly inform the user they are applying for an independent line of credit.


SECTION 7: INSTITUTIONAL AND TRADEMARK DISCLOSURE REGARDING DSCC

Castor Home Nursing Inc. is an independent, licensed, and accredited home health services provider. Any reference on this website to the Division of Specialized Care for Children (DSCC) or the Core/Home Care Regional Waiver Programs is for informational, alignment, and billing disclosure purposes only.

DSCC is a state-governed organization administered by the University of Illinois Chicago (UIC). Enrollment in DSCC programs, clinical eligibility assessments, and the allocation of authorized home nursing hours are determined exclusively by DSCC. Authorization to provide services does not imply an exclusive partnership, endorsement, or joint venture between Castor Home Nursing Inc. and the University of Illinois Chicago.


SECTION 8: COOKIE & DIGITAL DATA TRACKING POLICY

Castor Home Health Solutions uses cookies, tracking pixels, web beacons, and local storage objects across our digital platforms to ensure proper website functionality, understand visitor interactions, and manage secure user sessions.

We use strictly necessary cookies for security, logins, and checkout. Functional and performance cookies are used to optimize course pages and local resources, and are bound by strict HIPAA marketing regulations.


SECTION 9: CREDIT CARD SECURITY & FINANCIAL TRANSACTION COMPLIANCE

All online financial transactions—including tuition payments for the Castor Health Institute, private-pay deposits for Non-Emergency Medical Transportation (NEMT), and direct purchases from Castor Medical Supplies—are routed through third-party payment gateways. Castor does not store raw credit card numbers or CVV codes on its public web servers. All payment transactions utilize end-to-end Secure Sockets Layer (SSL/TLS) encryption in compliance with the Payment Card Industry Data Security Standard (PCI-DSS).


SECTION 10: E-COMMERCE SHIPPING, FULFILLMENT, & DELIVERY POLICY

Castor Medical Supplies fulfills orders across the state of Illinois and nationwide where permitted by manufacturing distribution licenses. Standard retail orders are processed within 2 to 3 business days. Specialized clinical equipment (DME), respiratory technologies, or custom mobility assets require physical inspection, setup, or a verified physician prescription under FDA rules.


SECTION 11: MANDATORY FEDERAL & STATE STATUTORY DISCLOSURES

1. Title VI Civil Rights & Nondiscrimination Statement

In accordance with Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, and the Age Discrimination Act of 1975, Castor Home Health Solutions does not discriminate, exclude individuals, or treat them differently on the basis of race, color, national origin, disability, age, sex, or preferred language.

2. Federal False Claims Act & OIG Compliance

Castor operates under a strict corporate integrity agreement aligned with the Office of Inspector General (OIG) guidelines. Any attempt to deliberately falsify clinical charting, manipulate insurance claims for unauthorized medical supplies, or bill for non-executed medical transportation trips is a violation of the Federal False Claims Act (31 U.S.C. §§ 3729-3733).

3. Illinois Workplace Safeguards & Abuse Reporting

Whistleblower Act: Castor protects all employees, independent contractors, and patients who report violations of state or federal laws, including clinical safety regulations, from any forms of workplace retaliation under 740 ILCS 174/.

Abuse and Neglect Reporting: In accordance with the Illinois Abused and Neglected Child Reporting Act (325 ILCS 5/), all field clinicians, instructors, and corporate officers working for Castor are legally designated as Mandated Reporters. Any suspected physical abuse, environmental neglect, or exploitation of pediatric patients or vulnerable individuals will be reported immediately to the Illinois Department of Children and Family Services (DCFS).
